Terms and Conditions

Effective January 1, 2026

PLEASE READ CAREFULLY. THESE TERMS ARE LEGALLY BINDING.

These Terms and Conditions ("Terms") govern your use of the website www.luckypennylagree.com, any related mobile applications, and all services provided by Lucky Penny Lagree LLC ("Lucky Penny Lagree," "we," "us," or "our") at our studio in Gilbert, Arizona (collectively, the "Services").

By purchasing classes, memberships, packages, booking sessions, entering the studio, or participating in any class or activity, you agree to be bound by these Terms without exception. If you do not agree, do not use the Services.

1. Eligibility & Account Responsibility

  • You must be at least 16 years old to participate. Participants under 18 require written parental/guardian consent. No one under 16 is permitted in classes.

  • You agree to provide accurate and current information when creating an account.

  • You are solely responsible for all activity on your account.

  • You must keep your login and payment information current.

  • Unauthorized use of accounts may result in immediate suspension or termination.

2.Membership Holds / Suspensions

  • Membership suspensions (“holds”) are permitted for a minimum of one (1) full billing month.

  • Each suspension is subject to a $30 hold fee, charged at the time the hold is placed.

  • Partial-month holds are not permitted.

  • Memberships may not be suspended retroactively.

  • During a hold period, membership access and benefits are paused and automatically resume at the end of the hold term.

  • Suspension requests must be submitted in accordance with studio procedures and are subject to approval.

3. Cancellation, Late Cancel & No‑Show Policy

All cancellations must be made through your account prior to the applicable window. No exceptions.

A. Unlimited Monthly Members

  • Must cancel at least 8 hours before class start time.

  • Late cancellation (within 8 hours): $10 fee, plus tax added at checkout.

  • No‑show: $20 fee,  plus tax added at checkout.

B. Class Packs, Drop‑Ins & Non‑Members

  • Must cancel at least 12 hours before class start time.

  • Late cancellation (within 12 hours): $15 fee,  plus tax added at checkout.

  • No‑show: $20 fee and loss of class credit,  plus tax added at checkout.

C. General Rules

  • Fees are automatically charged to the card on file.

  • Class credits forfeited due to late cancellation or no‑show will not be reinstated.

  • You must wear grip socks throughout the entire duration of your class.

  • Being added from the waitlist within the cancellation window still counts and all fees apply.

4. Reservations, Arrival & Waitlist Policy

  • Arrive no later than 5 minutes after class start time. Late arrivals may be denied entry.

  • Spots may be released to the waitlist once class begins.

  • First‑time clients must arrive 15 minutes early or may forfeit their spot.

  • Waitlist additions may occur up to 2 hours before class.

5. Studio Conduct & Prohibited Activities

You agree to:

  • Follow all posted studio rules and instructor guidance.

  • Treat staff, instructors, and members with respect.

  • Use equipment properly.

Prohibited conduct includes, but is not limited to:

  • Harassment or disruptive behavior

  • Unsafe participation

  • Damage or misuse of equipment

  • Unauthorized recording

  • Solicitation or promotion

Violations may result in removal from class or termination of membership without refund

6. Personal Property

  • Lockers are provided for convenience only.

  • Lucky Penny Lagree is not responsible for lost, stolen, or damaged items.

  • Personal belongings are brought into the studio at your own risk.

7. Assumption of Risk & Physical Condition

You understand and acknowledge that participation in Lagree Method fitness classes and related activities involves inherent risks, including but not limited to muscle strains, sprains, tears, falls, equipment-related injury, dizziness, cardiovascular events, and other serious physical injuries.

You voluntarily assume all risks, known and unknown, associated with participation. You affirm that you are physically capable of engaging in strenuous exercise and that you have not been advised against participation by a medical professional. You acknowledge that Lucky Penny Lagree does not provide medical advice and is not responsible for monitoring your physical condition.

8. Release, Waiver & Indemnification (Arizona Specific)

To the fullest extent permitted by Arizona law, you voluntarily, knowingly, and expressly agree to hereby release, waive, discharge, and covenant not to sue Lucky Penny Lagree LLC, its members, managers, employees, instructors, independent contractors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, injuries, losses, costs, or expenses of any kind, whether known or unknown, foreseen or unforeseen, arising out of or related to your participation in the Services.

This release expressly includes claims arising from the ordinary negligence of the Released Parties, but does not apply to claims resulting from gross negligence or willful misconduct to the extent prohibited by Arizona law.

You further agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, costs, and attorneys’ fees arising from or related to your actions, participation, or violation of these Terms, including injury to yourself or others and damage to property, whether occurring on or off the premises.

9. Media Release

You grant Lucky Penny Lagree the irrevocable right to photograph, video, and record you during classes or events and to use such media for marketing and promotional purposes without compensation.

10. Payments & Credit Card Authorization

You authorize Lucky Penny Lagree to:

  • Store your payment method on file.

  • Charge your card for memberships, late fees, no‑shows, retail, and outstanding balances.

  • Update charges automatically upon pricing or policy changes.

11. Refunds, Credits & Chargebacks

ALL SALES ARE FINAL. NO REFUNDS, PRORATIONS, OR CREDITS will be issued for memberships, class packs, drop‑ins, late cancellations, no‑shows, missed classes, unused sessions, schedule changes, instructor substitutions, or early termination for any reason.

You agree not to initiate chargebacks or payment disputes for charges that are consistent with these Terms. Any chargeback initiated in violation of this policy constitutes a material breach and may result in account suspension or permanent termination.

12. Intellectual Property

All content, branding, trademarks, logos, and materials are the exclusive property of Lucky Penny Lagree and may not be copied, distributed, or used without written consent.

13. Privacy

We collect only information necessary to provide Services and do not sell your data. Use of the Services constitutes consent to our privacy practices.

14. Third‑Party Links

We are not responsible for third‑party websites, services, or content linked through our site or app.

15. Suspension & Termination of Services

Lucky Penny Lagree reserves the right, in its sole discretion, to suspend or terminate your account, membership, or access to Services at any time, with or without notice, for violation of these Terms, unsafe behavior, non-payment, misconduct, or any action deemed detrimental to the studio or its community.

Termination does not relieve you of any outstanding payment obligations. No refunds or credits will be issued upon suspension or termination for any reason.

16. Dispute Resolution, Arbitration & Governing Law

Mandatory Arbitration. YOU AND LUCKY PENNY LAGREE AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS, THE SERVICES, YOUR MEMBERSHIP, OR YOUR PARTICIPATION IN ANY ACTIVITY SHALL BE RESOLVED EXCLUSIVELY BY FINAL AND BINDING ARBITRATION.

Arbitration shall be conducted in Maricopa County, Arizona, administered by a single neutral arbitrator, and governed by the Arizona Revised Statutes and, where applicable, the Federal Arbitration Act. The arbitrator shall have authority to award monetary damages consistent with Arizona law but shall have no authority to award punitive or exemplary damages except as expressly permitted by statute.

Waiver of Jury Trial & Class Actions. YOU AND LUCKY PENNY LAGREE TO WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. Claims must be brought on an individual basis only.

Governing Law. These Terms shall be governed by and construed according to the laws of the State of Arizona, without regard to conflict-of-law principles.

17. Modifications to Terms

Lucky Penny Lagree may modify these Terms at any time without prior notice. Updated Terms will be posted on the website and/or made available in the studio. Your continued use of the Services following any modification constitutes binding acceptance of the updated Terms. Taxes are subject to change based on city/state rates.

Assignment

You may not assign or transfer your rights and obligations under this agreement without obtaining prior written consent from Lucky Penny Lagree. Any unauthorized transfer will be void. We may assign or transfer this agreement, which will bind and benefit the respective parties and successors.

Fees

Lucky Penny Lagree reserves the right to charge fees for its services and adjust those fees at its discretion. Taxes are subject to change based on city/state rates.

Intellectual Property

The content on our site and mobile app, including text, software, graphics, videos, and logos (collectively "Content"), is owned or licensed by Lucky Penny Lagree. This content is protected under copyright and intellectual property laws.

You may not copy, distribute, modify, or use the content without prior written consent. Feedback provided by you is considered non-confidential and may be used by Lucky Penny Lagree at its discretion. By submitting feedback, you grant Lucky Penny Lagree the right to use, adapt, or share it without obligation or compensation.

Refund Policy

All services, memberships, and class packages are non-refundable. Returns of merchandise are at the discretion of Lucky Penny Lagree.

Release & Indemnity Agreement

This PARTICIPANT RELEASE AND INDEMNITY AGREEMENT (“Agreement”) is entered into between Lucky Penny Lagree LLC (hereafter referred to as “Lucky Penny Lagree”), an Arizona limited liability company, and the undersigned participant (hereafter referred to as “Participant”). The undersigned also includes any parent or legal guardian of a minor Participant, if applicable.

By signing this Agreement, the Participant (or their legal guardian) acknowledges the inherent risks of participating in the fitness programs offered by Lucky Penny Lagree, and agrees to release and hold harmless the company, its employees, contractors, agents, and affiliates (collectively referred to as “Released Parties”).

1. Acknowledgment of Risks
The Participant understands that engaging in fitness activities, including training and exercises, can involve significant physical effort and may present risks such as physical injury or discomfort. The Participant accepts these risks voluntarily and assumes full responsibility for any injuries, illnesses, or damages that may occur, whether caused by their actions, the actions of others, or the conditions of the facilities.

2. Health and Fitness Condition
By participating, the Participant confirms that they are physically capable of engaging in the fitness programs provided by Lucky Penny Lagree and have no known medical conditions or physical limitations that would prevent their participation. If the Participant has concerns about their health, they are encouraged to consult a healthcare professional before beginning any fitness activity.

3. Waiver of Claims
To the fullest extent permitted by law, the Participant releases and discharges Lucky Penny Lagree and the Released Parties from any liability, claims, demands, or actions that could arise out of their participation in the fitness activities, including but not limited to those resulting from negligence, accidents, or injuries sustained while at the studio or participating in any related activities.

4. Medical Advice and Responsibility
The Participant acknowledges the importance of seeking medical advice prior to engaging in any physical activity, particularly if they have any existing medical conditions, injuries, or are pregnant. The Participant accepts full responsibility for determining whether they are fit to participate.

5. Indemnification
The Participant agrees to indemnify and hold harmless the Released Parties from any and all claims, losses, liabilities, or expenses (including legal fees) arising from the Participant's actions or involvement in the fitness programs, use of the studio or equipment, or any related activities, whether caused by negligence or otherwise.

6. Personal Property
The Participant acknowledges that any personal property brought into the studio or other premises used by Lucky Penny Lagree is at their own risk. Lucky Penny Lagree will not be responsible for the loss, theft, or damage of any personal items.

7. Media Consent
The Participant grants Lucky Penny Lagree the right to capture and use photographs, videos, and other media of the Participant during classes or events for promotional purposes, including use on the company's website, social media platforms, and advertising materials. The Participant waives any claims for compensation related to such media.

8. Dispute Resolution
In the event of any disputes or legal actions arising from this Agreement, the parties agree to resolve matters through binding arbitration in accordance with the laws of Arizona. The Participant consents to the jurisdiction and venue of the state of Arizona for such proceedings.

9. Credit Card Authorization
The Participant agrees to provide and maintain current payment information on file with Lucky Penny Lagree for the purpose of processing payments for services and fees. The Participant authorizes Lucky Penny Lagree to charge their credit card for any outstanding amounts due.

10. Privacy and Confidentiality
Lucky Penny Lagree is committed to protecting the Participant’s personal information. All personal data provided will remain confidential and will only be used in accordance with privacy policies designed to support the Participant’s needs.

11. Acknowledgment of Understanding
By signing this Agreement, the Participant acknowledges that they have read, understood, and voluntarily agree to the terms and conditions set forth herein. This Agreement is binding upon the Participant, their heirs, and legal representatives.
