Lucky Penny Lagree:
Membership Agreement

Effective January 1, 2026

This Membership Agreement (“Agreement”) is a legally binding contract between Lucky Penny Lagree LLC (“Lucky Penny Lagree,” “we,” “us,” or “our”) and the individual purchasing a recurring membership (“Member,” “you,” or “your”).

This Agreement applies only to membership billing and membership usage.
All clients are also bound by the Lucky Penny Lagree Terms & Conditions (“Studio Terms”), which are incorporated into this Agreement by reference. The Studio Terms govern studio rules, legal rights, liability, conduct, and arbitration.
If there is a conflict, the Studio Terms control.

By purchasing or renewing a membership, you agree to all terms below.


1. Membership Term, Renewal & Minimum Commitment

1.1 Month-to-Month Membership

Your membership begins on the date of purchase (“Commencement Date”) and continues on a recurring month-to-month basis until cancelled under Section 3.

1.2 Automatic Billing

Membership dues are automatically charged to the payment method on file on the same calendar day each month (or on the nearest business day).

1.3 Two-Month Minimum Commitment

Memberships require a minimum commitment of two (2) consecutive, fully paid billing cycles.

  • Cancellation cannot take effect before the second full billing cycle is completed.

  • Memberships may not be purchased or maintained for less than this minimum commitment.


2. Billing, Payments, and Charges

2.1 Payment Authorization

You authorize Lucky Penny Lagree to charge your stored payment method for:

  • Monthly membership dues

  • Late cancellation fees

  • No-show fees

  • Hold/suspension fees

  • Additional same-day class fees

  • Any outstanding balances

2.2 Failed Payments

If a payment is declined:

  • Booking privileges may be suspended

  • We may reattempt charges

  • A valid payment method must be provided

  • You remain responsible for all outstanding amounts

2.3 Price Changes

Membership rates may change at any time. Continued use of your membership after notice of a price change constitutes acceptance.


3. Cancellation & Downgrade Policy

3.1 30-Day Written Notice Required

A minimum of 30 days’ advance written notice is required to cancel or downgrade a membership.

Verbal requests (in person, text, phone call, social media, or DM) will not be accepted.

3.2 Effective Date of Cancellation

  • If your written notice is received at least 30 days before your next billing date → your membership ends at the conclusion of the current paid billing cycle.

  • If notice is given within 30 days of your next billing date → one additional monthly charge may occur, and termination will take effect at the end of that billing cycle.

3.3 No Refunds or Prorations

Consistent with the Studio Terms:

  • All sales are final.

  • No refunds, credits, or prorations exist for partial months, unused time, late cancellations, or early termination.

  • You may continue using your membership until the final paid date.

3.4 Downgrades

Downgrades follow the same 30-day written notice rule and become effective on a future billing date.


4. Membership Holds (Suspensions)

4.1 Eligibility

Members may request a temporary hold (“Hold”) on their membership subject to all conditions below.

4.2 Minimum Hold Length

  • Holds must be a minimum of one (1) full billing month

  • Partial-month holds are not permitted

  • Holds may not be applied retroactively

4.3 Hold Fee

Each approved hold is subject to a non-refundable $30 hold fee, charged at the time the hold is placed.

4.4 Duration & Limits

Lucky Penny Lagree may limit the total number or duration of hold periods in any 12-month span at its discretion.

4.5 Reactivation

Membership automatically reactivates at the end of the hold period at the then-current membership rate unless cancelled according to Section 3.


5. Booking, Class Usage, and Daily Limits

5.1 Daily Class Limit (1x-Per-Day Memberships)

Members on “1 class per day” memberships:

  • May reserve one (1) class per day using their membership

  • Additional same-day classes will be charged the current drop-in rate (currently $30/class)

5.2 Compliance with Studio Terms

All booking, attendance, and conduct rules in the Studio Terms apply.


6. Late Cancel & No-Show Fees (Members Only)

6.1 Late Cancellation

Members must cancel at least 8 hours before the class start time.
Late cancellations incur a $10 fee.

6.2 No-Show

Failure to attend a booked class results in a $20 no-show fee.

6.3 Fee Processing

Fees are automatically charged to the card on file and are non-refundable.


7. Waitlist Policy

7.1 Automatic Enrollment

Members may be automatically added to class from the waitlist up to 2 hours before the start time (or as early as 4:00 a.m. for 6:00 a.m. classes).

7.2 Notifications

Members are responsible for enabling and checking notifications.
Failure to see a notification does not exempt you from fees.

7.3 Fees Apply Once Enrolled

If you are added to class from the waitlist, standard cancellation and no-show fees apply.


8. Termination by Lucky Penny Lagree

Lucky Penny Lagree may suspend or terminate your membership immediately for:

  • Non-payment

  • Violation of the Studio Terms

  • Unsafe or disruptive behavior

  • Conduct detrimental to the studio community

No refunds or credits will be issued upon termination.
You remain responsible for outstanding balances.


9. Agreement & Acknowledgment

By purchasing or renewing a membership, you:

  • Agree to this Membership Agreement

  • Agree to the Lucky Penny Lagree Studio Terms & Conditions

  • Acknowledge that Lucky Penny Lagree may update this Agreement at any time

  • Understand that continued membership use constitutes acceptance of updated terms
